ODE Scotland: Terms of Service
Welcome to Original Design Engineering (ODE) Scotland. By commissioning work or using our services, you agree to the following terms and conditions. These terms are designed to protect both your project and our studio.
1. Basis of Service
Bespoke Nature: ODE Scotland provides custom design, technical fabrication, and prototyping services. Because these items are manufactured to your specific requirements, they are exempt from standard "change of mind" return policies under UK Consumer Contracts Regulations.
Technical Advice: Any technical suggestions or design "remixes" provided by ODE Scotland are based on a decade of industry experience. However, the final responsibility for ensuring a design meets the user’s specific safety or regulatory requirements rests with the client.
2. Intellectual Property (IP)
Our Designs: Unless otherwise agreed in writing, ODE Scotland retains the Intellectual Property rights for all original designs, CAD files, and functional solutions created by us.
Client-Provided Files: By providing files (STL, STEP, Sketches, etc.) for manufacture or remixing, you confirm that you own the rights to these designs or have explicit permission to use them. You agree to indemnify ODE Scotland against any third-party copyright or patent claims.
3. The Business Prototype Program
Eligibility: The "Free Initial Prototype" offer is available to business clients for project validation at our discretion.
Ownership: Free prototypes remain the property of ODE Scotland. They are provided as a "Proof of Concept" for fit and form, and may not represent the final mechanical strength or material finish of a production-grade part.
4. Payments, Quotes, and Lead Times
Quotes: All quotes are valid for 30 days. Work begins only once the deposit or full payment (as agreed) is received.
Lead Times: Any provided timescales are estimates. While we strive for "Rapid Prototyping," delays may occur due to machine maintenance, material availability, or complex technical challenges. We will communicate any significant changes to your timeline immediately.
5. Liability and Intended Use
Prototyping Limits: 3D-printed parts—while strong—have different mechanical properties than injection-molded plastics. ODE Scotland is not liable for failures, damage, or injury resulting from the use of prototypes in high-stress, mission-critical, or load-bearing applications unless specifically designed and tested for such use.
Repairs: For technical reconstruction or repair of obsolete parts, ODE Scotland is not responsible for further damage to the original "donor" part provided for replication.
6. Shipping and Delivery
Local Pickup: We offer in-person consultations and pickups for clients in the Dundee area by appointment.
Postage: Items are shipped from Dundee via tracked services. ODE Scotland is not responsible for delays caused by the courier once the item has left our studio.
7. Cancellations and Refunds
Cancellations: Orders for custom manufactured goods cannot be cancelled once the printing or fabrication process has started.
Faulty Goods: In the unlikely event that a part arrives with a manufacturing defect, please contact Skylar@odescotland.com within 7 days of receipt to arrange a replacement or repair.
